The Federal Communications Commission Announces 3-Month Adjustment of Start Date for Wave 4, Stage 1 Reconfiguration

March 7, 2006, Washington, D.C - The Federal Communications Commission announced through a Public Notice on March 3, 2006 that 800 MHz band reconfiguration for Wave 4, Stage 1 licensees will commence July 3, 2006. This is a three-month adjustment from the initial planned start date of April 3, 2006. The additional three months is to allow more time to address international border issues with Canada and Mexico.

The three-month voluntary negotiation period for Wave 4, Stage 1 will begin on July 3, 2006 and end on October 2, 2006. During this time, licensees and Sprint Nextel may negotiate a Frequency Reconfiguration Agreement (FRA), which outlines the terms and conditions of their system reconfiguration. The three-month mandatory negotiation period will begin on October 3, 2006 and end on January 2, 2007. During Mandatory Negotiations, all parties are required to negotiate in good faith, and either party may request TA assistance to help mediate an FRA. Licensees who are unable to reach an FRA during Voluntary or Mandatory Negotiations will enter Alternative Dispute Resolution (ADR) on January 3, 2007.

800 MHz licensees should be aware of the following:
  • The TA will send all Wave 4 licensees an Information Package in the beginning of May, 2006. This package will be mailed to the address on file with the FCC, unless the licensee has submitted a Point of Contact (POC) Form to the TA. POC Forms are available on the TA's website. If, by the start of Voluntary Negotiations (July 3, 2006), you have not received this mailing, please contact the TA at comments@800ta.org or (888) 800-8220.
  • A Frequency Proposal Report (FPR) containing the TA's frequency proposals will be mailed to licensees with affected call signs. These will be mailed to the address on file with the FCC, unless the licensee has submitted a POC Form to the TA.
  • Licensees receiving FPRs will be contacted by Sprint Nextel to begin reconfiguration negotiations. If you do not hear from Sprint Nextel, contact Sprint Nextel at 800MHz@Sprint.com.
  • To facilitate the 800 MHz reconfiguration process, please ensure that your license information in the ULS database is current and that you have completed and submitted a TA Point of Contact (POC) Form.
  • The TA's reconfiguration guidance is available at www.800TA.org.
About the 800 MHz Transition Administrator, LLC
800 MHz Transition Administrator, LLC ("TA LLC") is the Transition Administrator ("TA") for the reconfiguration of the 800 MHz band mandated by the Federal Communications Commission ("FCC"). TA LLC has contracted with BearingPoint, Inc., Squire, Sanders & Dempsey L.L.P. and Baseline Telecom, Inc. to perform the duties of the TA. Among its duties, the TA establishes reconfiguration guidelines, specifies replacement channels, reviews reconfiguration cost estimates, monitors payment of reconfiguration costs, manages the relocation schedule, facilitates issue resolution and administers the alternative dispute resolution process. TA LLC uses information it receives solely for the purposes of administering the 800 MHz reconfiguration process and may disclose such information to the FCC or other authorized parties pursuant to the requirements of the 800 MHz Order or other applicable laws.
